Terms of Service

These Terms of Service (the "Terms") govern the use of the GeckoDub platform (the "Service"), managed and operated by 8logic d.o.o. (the "Provider", "we", "us"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Description of Service
GeckoDub is an all-in-one localization platform for e-commerce content, including video translation (with lip-syncing), voiceover generation, static ad translation, and subtitle generation.
2. Use of Third-Party Technologies and the Nature of AI
GeckoDub utilizes advanced artificial intelligence technologies provided by external vendors ("Third-Party Providers").
"As-is" Model and Unpredictability
The User acknowledges that the nature of generative artificial intelligence is stochastic (probabilistic). Results regarding localization, synchronization, and translations may be unpredictable, vary between instances, and may not always be perfect. The Provider does not guarantee specific aesthetic quality or the absolute accuracy of the generated content.
Changes
The Provider reserves the right to replace or update Third-Party Providers at any time without prior notice.
Service Availability
The Service is provided on a commercially reasonable basis. We do not guarantee uninterrupted access, specific uptime levels, or guaranteed response times unless explicitly agreed in a separate written agreement. Planned maintenance, third-party outages, or technical issues may temporarily affect availability.
3. Ownership and Copyright
User Input
The User warrants that they possess all necessary rights, licenses, and permissions for the content (video, audio, images) uploaded to the platform.
User Output
The User is the exclusive owner of the localized content generated through the Service.
Copyright Exception
Due to the current nature of AI-generated content, the Provider does not guarantee that the Output is fully protectable under copyright law in all jurisdictions.
4. Limitation of Liability and Indemnification
Intellectual Property
The Provider is not liable for any third-party claims or lawsuits regarding copyright infringement resulting from the User's content or the use of generated Output.
Indemnification
The User agrees to defend, indemnify, and hold the Provider harmless from and against any claims, losses, or expenses (including legal fees) arising from the User's breach of these Terms or the use of the generated content.
Financial Limitation
The Provider's total aggregate liability for any claim shall be limited to the amount paid by the User for the Service in the last 3 months immediately preceding the event giving rise to the claim.
5. Prohibited Use
The User agrees not to use the platform for:
- Creating "deepfake" content without the express written consent of the individuals appearing in the footage. The User represents and warrants that they have obtained and can document such consent for every identifiable person whose likeness or voice is processed through the Service. The User is solely responsible for verifying these consents, and the Provider shall not be liable for any claims arising from the User's failure to do so, as further covered by the indemnification provisions in Section 4.
- Localizing content featuring minors (individuals under the age of 18).
- Generating offensive, hateful, adult or illegal content.
- Developing competitive services through reverse engineering or automated data collection (scraping).
6. Payments, Subscriptions, and Refunds
Payment Processing
All payments are securely processed through our third-party provider, Stripe. The Provider does not store your credit card information. By using the payment services, you also agree to Stripe's terms and conditions.
No Refund Policy
Due to the nature of the Service, where each processing action incurs direct costs from Third-Party AI Providers, all payments are final. Refunds are not available based on dissatisfaction with the AI-generated result (e.g., unsatisfactory lip-sync or voice tone), as the User is informed of the unpredictable nature of AI outputs (Section 2). Each generation incurs immediate processing costs that cannot be recovered, which is why all payments are final.
Cancellation
Subscriptions can be canceled at any time via the user interface. Access to paid features will remain available until the end of the current billing period.
7. Account Security
The User is responsible for maintaining the confidentiality of their password and account credentials. Any activity performed through the User's account shall be deemed the activity of the User.
8. Data Protection
Data is shared with Third-Party Providers only to the extent necessary to execute the localization services. For more information, please refer to our Privacy Policy.
8.1 AI Training and Data Use
The Provider does not use User Input (videos, audio, images, scripts, or any uploaded content) to train, fine-tune, or improve any AI models.
The Service relies on Third-Party Providers (as described in Section 2) whose own terms may permit them to use submitted content to train or improve their models. The Provider does not control these practices. Custom enterprise arrangements with stricter data handling terms are available upon request at info@geckodub.com.
9. Suspension and Termination
We reserve the right to suspend or terminate any account, with or without notice and without refund, in cases including but not limited to:
- Violation of these Terms, including the Prohibited Use provisions in Section 5;
- Fraudulent activity, chargebacks, or unpaid invoices;
- Use of the Service for illegal purposes or in a manner that exposes the Provider to legal, reputational, or financial risk;
- Abuse of the platform, Third-Party Providers, or other users.
Upon termination, the User's access to the Service and any generated content stored on the platform may be revoked. The User is responsible for downloading and backing up their Output prior to termination.
10. Final Provisions
These Terms shall be governed by and construed in accordance with the laws of the Republic of Slovenia. Any disputes shall be resolved amicably; otherwise, the competent court in Ljubljana shall have exclusive jurisdiction. The Provider may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
